Montana's shutoff law, in plain terms
Montana electric providers are now expected to plan for cutting power on purpose. This page explains what that framework does, who it reaches, how long you can expect to be dark, and what an engineered backup system has to cover to make it a non-event.

The law
HB 490 put de-energization into the plan
Requires electric providers to include de-energizing strategies in their wildfire mitigation plans. This is the legal basis for planned, proactive power shutoffs during extreme wildfire conditions.
What it means for you
Your utility is now expected to have a written plan for cutting your power on purpose when fire weather looks bad. A shutoff under that plan is not a failure of the grid. It is the grid working the way the state now allows.
Why utilities will use it
A provider that follows an approved wildfire mitigation plan is in a far stronger legal position when it de-energizes. The practical effect for customers is that the decision to cut power is easier to make and harder to argue with after the fact.
Already in practice. NorthWestern Energy maintains an active Public Safety Power Shutoff plan, and Bonneville Power Administration has already shut transmission-level power to Flathead Electric members in Libby under wildfire risk. The Libby de-energization is the part Montanans should read twice. It already happened, it was preventive rather than reactive, and the customers affected had no equipment failure of their own to point at.

NorthWestern Energy, Flathead Electric Cooperative, Missoula Electric Cooperative, Vigilante Electric and the other Montana co-ops all sit downstream of the same wildfire mitigation framework, and transmission-level cuts by Bonneville Power Administration can take a whole service territory dark regardless of what the local utility decides.
- Investor-owned utility
- NorthWestern Energy operates a Public Safety Power Shutoff program covering its Montana distribution territory.
- Rural electric cooperatives
- Flathead, Missoula, Vigilante and the other co-ops apply the same wildfire mitigation framework across the long rural feeders where restoration patrols take the longest.
- Federal transmission
- Bonneville Power Administration can de-energize at the transmission level, which takes a whole co-op service area dark no matter what the co-op decides. Libby is the working example.
- Regional grid operator
- Separately, DOE Order No. 202-26-37 lets SPP direct private backup generation as a last resort during a regional emergency. Different mechanism, same conclusion about owning your own capacity.
Timeline
How a planned shutoff actually runs
- Fire weather builds
- Wind, humidity, temperature and fuel moisture cross the thresholds written into the provider's wildfire mitigation plan. The watch starts well before any customer hears about it.
- The provider makes a call
- De-energization is evaluated circuit by circuit. Notice goes out if there is time to send it, through the channels the utility has on file for you.
- Lines are opened
- Power stops. This is not a fault, so there is no crew dispatched to find and fix anything. The circuit stays open while conditions hold.
- Conditions clear
- The weather trigger has to pass first. Only then does restoration start.
- Patrol and re-energize
- Every affected mile is inspected for damage or hazards before it is put back in service. On long rural feeders this is the slow part, and it is measured in days.
The important number is the last step. A storm outage ends when the crew fixes the fault. A public safety shutoff ends when the weather clears and the whole circuit has been walked. Size your backup for days of runtime, not hours.

What stops when the line opens
- Well water
- No power, no pump. Household water, livestock water and any fire suppression that depends on the well all stop at the same moment.
- Heat and freeze protection
- Furnace controls, boiler pumps, heat tape and shop heaters are electric even when the fuel is not. Fire season shutoffs get the attention; the freeze risk is the one that writes the insurance claim.
- Refrigeration
- Household freezers, restaurant walk-ins, clinic vaccine and medication storage, and milk or meat inventory on a working ranch.
- Medical and life safety
- Oxygen concentrators, CPAP, powered mobility, home dialysis, and any clinic running scheduled care.
- Business continuity
- POS terminals, servers, phones, internet, security and access control, and every hour of revenue that stops when they do.
- Irrigation and livestock
- Pivots, stock tank heaters, ventilation fans and automatic feeders. A multi-day outage in the wrong week is a crop or a herd.
Fire season shutoffs are the new exposure. Winter has always been the old one. A well pump, a furnace control board, and a barn heater do not care which of the two took the line down.
